Resumo
Este estudo é um Trabalho de Conclusão de Curso. O tema é a extradição de Cesare Battisti e o problema de pesquisa destina-se a estudar por que Cesare Battisti não foi extraditado. O objetivo geral é demonstrar as razões do por que Cesare Battisti ainda não foi extraditado. A revisão bibliográfica, que representa o capítulo 2, tem como objetivos específicos destacar aspectos conceituais sobre o Estado; demonstrar a relação do Estado com o indivíduo nacional e estrangeiro; apresentar aspectos conceituais sobre o Direito Penal, os crimes internacionais e os crimes cometidos por ou no estrangeiro; descrever a relação do Estado com o indivíduo que comete crime no estrangeiro - punição, extradição e proteção diplomática. Na apresentação e análise dos dados, os objetivos específicos abordados são a apresentação do relato histórico do caso; descrever a legislação brasileira relativa ao asilo e ao refúgio; identificar a legislação brasileira relativa à extradição e analisar o caso Cesare Battisti à luz dos parâmetros legais brasileiros. Este trabalho é definido como um estudo de caso, com pesquisa bibliográfica, exploratória e qualitativa com a utilização de método indutivo, sendo submetido à análise em banca. Contrariando a decisão do Ministro da Justiça, Tarso Genro, em conceder refúgio político a Cesare Battisti, o STF decidiu por anular o status de refugiado, por considerar que os crimes cometidos por ele foram crimes comuns. Após o demorado julgamento do caso, o STF deferiu a extradição do italiano, mas a entrega ou não de Cesare Battisti ainda depende do Presidente da República, que deverá levar em consideração o Tratado de Extradição entre Brasil e Itália, a decisão do STF e as relações internacionais do país
This study has as it's the theme is the extradition of Cesare Battisti and whose research problem is studying why Cesare Battisti was not extradited. The overall objective is demonstrating the reasons why Cesare Battisti has not yet been extradited. The review, which represents the second chapter, has as its specific aims, highlighting conceptual aspects about the State; demonstrating the relationship of the State with the national and foreign subject; presenting the conceptual aspects of criminal law, international crimes and the crimes committed by foreigners or abroad, describing the relationship between the state and the subject who commits a crime abroad - punishment, extradition, and diplomatic protection. In the presentation and data analysis, the specific aims addressed are presenting the historical report of the case, describing the Brazilian legislation on asylum and refuge; Identifying the Brazilian legislation on extradition; and analyzing the Cesare Battisti case in light of legal brazilian standards. This research is a case study is defined as a case study, with bibliographical, exploratory and qualitative research with the use of inductive method, undergoing banking submitted to a Board Committee. Contrary to the decision of the Ministerof Justice, Tarso Genro, to grant political refuge to Cesare Battisti, the STF decided to annul the status of refugee, considering that the crimes committed by him were common crimes. After the slow trial of the case, the STF upheld the extradition of Italian, but delivery or not Cesare Battisti still depends on the President of the Republic, which should take into account the Extradition Treaty between Brazil and Italy, the STF decision and foreign relations
