Resumo
Este estudo tem como objetivo analisar questões relativas ao aborto à luz da (in)existência de uma tendência rumo a descriminalização no Brasil, a partir de uma investigação do contexto histórico, filosófico, jurídico-penal e jurisprudencial. O debate sobre o aborto não é algo recente e remonta períodos da Antiguidade. Embora não seja uma discussão nova, percebe-se que em cada momento da história a problemática tem ocupado as principais pautas com enfoques diferentes, especialmente a partir do momento em que o aborto deixa de ser algo exclusivo e de foro íntimo da mulher e passa a ser inserto na esfera pública. Para realização deste trаbаlhо, adotou-se o métоdо dе аbоrdаgеm indutivo e o método de procedimento foi o histórico, fazendo uso também da MAD - Metodologia de Análise de Decisões. Destarte, chega-se à conclusão de que, em razão dos precedentes sobre a temática, da evolução social, o reconhecimento de novos direitos conquistados ao longo de séculos e a atual conjuntura do papel desenvolvido pela mulher na sociedade contemporânea, é possível apontar que o aborto figura como um produto do subdesenvolvimento, tendo em vista que quase cem por cento dos países desenvolvidos do mundo já flexibilizaram as reprimendas penais criminalizadoras da prática, elevando a dignidade da pessoa humana, a liberdade reprodutiva e sexual da mulheres, o direito à saúde, a vedação a tortura física e psicológica, é possível apontar que existe no Brasil uma tendência Slippery Slope em direção a descriminalização do aborto.
This study aims to analyze abortion issues in light of the (in)existence of a tendency toward decriminalization in Brazil, based on an investigation of the historical, philosophical, legal-penal and jurisprudential contexts. The debate on abortion is not a recent one and goes back to periods of antiquity. Although it is not a new discussion, it is noticed that in every moment of history the problem has occupied the main guidelines with different approaches, especially from the moment in which the abortion ceases to be something exclusive and intimate forum of the woman and becomes be inserted in the public sphere. For the accomplishment of this trаbаlhо, it was adopted the inductive métоdо dе аbоrdаgеm and the procedure method was the historical, making use also of the MAD - Decision Analysis Methodology. From this, it is concluded that, due to the precedents on the theme, social evolution, the recognition of new rights conquered over centuries and the current conjuncture of the role of women in contemporary society, it is possible to point out that the abortion figures as a product of underdevelopment, given that nearly one hundred percent of the world's developed countries have already relaxed the criminal reprimands criminalizing the practice, raising the dignity of the human person, women's reproductive and sexual freedom, the right to health, the fence to physical and psychological torture, it is possible to point out that there is a tendency in Brazil for Slippery Slope towards the decriminalization of abortion.
