Resumo
Apesar de já fazer mais de cinco anos desde que o Código de Processo Civil foi atualizado, a discussão acerca da inserção do artigo 139, IV ao CPC ainda traz diversas discussões para o âmbito jurídico nos dias de hoje, uma vez que temos correntes divergentes no Brasil acerca do tema. A ideia da pesquisa portanto, é abordar as correntes doutrinárias existentes a respeito deste instituto, trazendo uma análise à luz dos princípios existentes no direito processual brasileiro, afim de se chegar a uma conclusão equilibrada ao interpretar este dispositivo que trouxe uma amplitude de poderes muito grande ao juiz, gerando certa insegurança jurídica.
Although it has been more than five years since the Code of Civil Procedure was updated, the discussion about the insertion of article 139, IV to the CCP still brings several discussions to the legal field nowadays, since we have divergent currents in the Brazil on the topic. The idea of the research, therefore, is to address the existing doctrinal currents regarding this institute, bringing an analysis in the light of existing principles in Brazilian procedural law, in order to reach a balanced conclusion when interpreting this provision that brought a very wide range of powers to the judge, generating some legal uncertainty.
