Resumo
Este estudo tem como objetivo analisar a aplicabilidade jurídica da lei geral de proteção de dados LGPD. Os objetivos específicos são: descrever a tutela constitucional e legal dos direitos do consumidor, discutir os princípios da proteção e os direitos fundamentais do consumidor e apresentar a responsabilidade das empresas no que diz respeito à aplicabilidade da referida lei. Trata-se de uma pesquisa de cunho bibliográfico, do tipo descritiva e de abordagem qualitativa. A revisão dos materiais bibliográficos pesquisados permitiram analisar que a Lei 13.709/2018 tem tutela constitucional, quando trata dos direitos fundamentais do consumidor, pois, se baseia no Código de Defesa do Consumidor, Lei nº 8.078/1990, estabelecendo que a privacidade de seus dados se refere e fundamenta o direito de proteção à vida, a liberdade, a dignidade humana e outros aspectos fundamentais. Assim, quem fornece seus dados mesmo que de forma consentida, tem o direito de ser amparado pela LGPD, sendo a empresa ou organização que os coleta, responsável por instituir uma política de proteção,
This study aims to analyze the legal applicability of the general data protection law LGPD. The specific objectives of the person are: To describe a constitutional and legal protection of the rights of the person and the consumer, the fundamental rights of the consumer person and to present the responsibility of the companies with respect to the referred law. A review of the researched materials allowed us to analyze that Law 13.709/2018 has constitutional protection, when it comes to fundamental consumer rights, as it is based on the Consumer Defense Code, Law nº 8.078/1990, establishing that the privacy of your data refers to the fundamental protection of life, liberty, human rights and other fundamental aspects.
