Resumo
O presente trabalho busca analisar a possibilidade de deferimento do pedido de regulamentação de visitas elaborado por pai socioafetivo. Para tanto, o método de abordagem utilizado foi o dedutivo. Justifica-se a aplicação deste método de abordagem, uma vez que a pesquisa partiu de um instituto base e amplo ¿ socioafetividade ¿ a partir do qual todo o raciocínio foi desenvolvido, para se concluir com respostas à problemática específica da possibilidade de deferimento do pedido de regulamentação de visitas elaborado pelo pai afetivo. No que tange ao procedimento técnico, a pesquisa utilizada foi a bibliográfica e o instrumento para a coleta de dados, o fichamento. Verificou-se que doutrina e jurisprudência atribuem como fundamento do direito de visita o vínculo de afeto existente entre visitante e visitado, de modo que o parentesco não influencia substancialmente no deferimento do pedido. Concluiu-se, portanto, que uma vez demonstrados os requisitos que corroboram a existência de socioafetividade no âmbito familiar, inegável a possibilidade de que pai e filho afetivos mantenham o convívio através da regulamentação de visitas.
This study aims to examine the possibility of granting the application of rules of hits produced by socio-emotional parent. Thus, the method of the deductive approach was used. Justified the application of this method of approach, since the search started from a broad base and institute - social affection - from which all reasoning is designed to conclude with responses to the specific problem of the possibility of granting the application regulatory visits prepared by the affectionate father. Regarding the technical procedure, the research literature and was used as an instrument for collecting data, book report. It was found that the doctrine and jurisprudence attribute the foundation of the right to visit the bond of affection between visitor and visited, so that kinship does not substantially affect the granting of the application. It was concluded therefore that since the requirements stated that corroborate the existence of socio-emotional in the family, undeniable the possibility of parent and child maintain emotional interaction through regulation of visits.
