Inconstitucionalidade do termo circunstanciado lavrado pela Polícia Militar no estado de Santa Catarina

O presente trabalho objetiva analisar a inconstitucionalidade do Termo Circunstanciado lavrado pela Polícia Militar no Estado de Santa Catarina, atividade autorizada pelo Decreto Estadual 660/07. Apesar de nossa Carta Magna prever de maneira expressa as atribuições de cada órgão que compõe o sistema de segurança pública, entregando à Policia Civil a atividade de Polícia Judiciária, bem como a responsabilidade por investigações criminais de qualquer natureza (exceto as infrações militares), e à Policia Militar a função de polícia ostensiva e preservação da Ordem Pública, ainda há grande discussão acadêmica e doutrinária sobre a atribuição para a lavratura do termo circunstanciado, devido à interpretação que se tem dado à expressão ¿Autoridade Policial¿ contida na Lei dos Juizados Especiais Criminais. De maneira preliminar, verificamos que o Código de Processo Penal estabelece que a Polícia Judiciária deva ser exercida por Autoridade Policial, sendo que, sobre a mesma matéria, a Constituição dispõe que à Polícia Civil, dirigida por Delegados de Polícia de Carreira, incumbe a função de Polícia Judiciária e apuração de infrações penais; assim, haveria razão bastante para afirmar que, em nosso sistema processual, a expressão Autoridade Policial estaria vinculada à carreira de Delegados de Polícia, situação que orientaria a interpretação quanto ao alcance da expressão cunhada no artigo 69 da Lei 9.099/95. Por outro lado, uma interpretação conforme a Constituição também faria com que entendêssemos dessa forma, uma vez que sendo o Termo Circunstanciado procedimento típico de polícia judiciária, sua lavratura somente poderia ser entregue a órgão constitucionalmente designado para exercer tal função, motivo pelo qual a expressão anteriormente mencionada somente poderia ser vinculada à autoridade de polícia judiciária, diga-se, Delegado de Polícia, e não a qualquer agente da autoridade a exercer funções de polícia administrativa. O método de abordagem empregado na elaboração do presente trabalho foi o dedutivo. O tipo de pesquisa utilizado foi o exploratório. Por fim, empregou-se a pesquisa bibliográfica através de doutrinas, artigos publicados na internet, análise da legislação e das interpretações jurisprudenciais. Concluiu-se no presente trabalho pela inconstitucionalidade formal e material do ato normativo que autoriza a lavratura do termo circunstanciado pela Polícia Militar no Estado de Santa Catarina, situação também capaz de provocar problemas de ordem prática. Tal entendimento, inclusive, encontra-se pacificado em julgados recentes do Supremo Tribunal Federal.
The aim of the present study is to analyze the unconstitutionality of the Detailed Written Report drafted by the Military Police in the state of Santa Catarina, an activity authorized by State Decree 660/07. Despite the fact that our Magna Carta explicitly sets out the duties of each entity that comprises the system of public security, by handing the Civilian Police the activity of Judicial Policing, as well as the responsibility for criminal investigations of any kind (except military infractions), and the Military Police the function of overt policing and the preservation of Public Order, there is still much discussion of an academic and theoretical nature concerning the duty of drafting the detailed written report, due to the interpretation that has been accorded to the expression ¿Police Authority¿ contained in the Law of the Special Criminal Courts. Initially we found that the Code of Criminal Procedure establishes that Judicial Policing should be exercised by Police Authority and, on the same topic, the Constitution states that the Civil Police, run by Career Chiefs of Police, engages in the job of Judicial Policing and the investigation of criminal infractions; so, there is sufficient cause to maintain that, in our procedural system, the expression Police Authority would be linked to the career of Chiefs of Police, a situation which would guide the interpretation in terms of the scope of the expression coined in article 69 of Law 9099/95. On the other hand, one interpretation according to the constitution would also give us to understand in this way given that, as the Detailed Written Report is a procedure typical of judicial policing, responsibility for its drafting should purely lie with the agency constitutionally designated to exercise this function, the reason for which the previously mentioned expression should only be linked to the judicial policing authority, in other words the Chief of Police and not to just any agent of authority, to exercise administrative police functions. The approach methodology employed in the preparation of the present study was deductive. An exploratory type of study was performed. Lastly, bibliographical research was conducted by examining legal theory, articles published on the Internet, analysis of the legislation and also the interpretation of case law. The present study reached a conclusion of the formal, material unconstitutionality of the regulatory act which authorizes the drafting of the detailed written report by the Military Police in the state of Santa Catarina, a situation which is also capable of causing problems of a practical nature. This understanding can indeed be seen to be determined in recent rulings by the Supreme Federal Court which.
