dc.description.abstractO presente trabalho possui o intuito de analisar sobre o crescimento exponencial da judicialização da saúde. A análise estará centrada sobre busca do Poder Judiciário para garantia do direito fundamental previsto no Art. 196 da CRFB/88. As determinações judiciais são instrumentos essenciais para efetivação da assistência pública à saúde? A pesquisa visa observar sobre a efetivação das políticas públicas através do Poder Judiciário sem prévia aprovação do Poder Executivo, destacando sobre uma possível usurpação de competência entre os Poderes da Federação. Ademais, cumpre destacar que o estudo também abordará sobre o Sistema Único de Saúde e sobre os privilégios da efetivação da assistência pública a saúde através do Poder Judiciário.pt
dc.description.abstractThis essay aims to analyze the exponential growth of the judicialization of health. The analysis will focus on the seek of the Judiciary to guarantee the fundamental right provided by Article 196 of the CRFB/88. Are judicial determinations essential instruments for making public health care effective? The research also aims to observe the implementation of public policies through the Judiciary without the prior approval of the Executive Branch, highlighting a possible usurpation of competence between the Branches of the State. In addition, it should be noted that the study will discourse about the «Sistema Único de Saúde» and the privileges of implementing public health care through the Judiciary.en
