O novo Código de Processo Civil e o direito de família: reflexos do diploma processual no âmbito jurídico familiar e a aplicabilidade das novas técnicas de resolução de conflitos

Goedert, Gisele Rodrigues MartinsStähelin, Brenda Schmitt2018-11-102020-11-262018-11-102020-11-262018https://repositorio.animaeducacao.com.br/handle/ANIMA/3946Based on the bibliographical research, the present study seeks to examine the main changes and reflexes that the new Code of Civil Procedure of 2015 has brought to the area of family law, as well as the innovations that involve the techniques of conflict resolution, with the purpose of presenting the changes, impasses and benefits of the main procedural changes inherent to family law, and to highlight the impetus that the procedural code brings to the application of new pacifying methods to solve conflictual demands in the juridical-family scenario. To this end, a study was carried out through relevant doctrines and legislation, as well as other scientific articles and researches, and it was concluded that the new civil procedural law brought about major changes and some refinement of the conflict, especially with regard to family matters, which, as will be shown, is a stimulus to the consensual solution founded and established by the sides themselves.Baseando-se na pesquisa bibliográfica, o presente estudo busca examinar as principais mudanças e reflexos que o mais novo Código de Processo Civil, de 2015, trouxe para a área do direito de família, bem como as inovações que envolvem as técnicas de resolução de conflitos, com o propósito de apresentar as alterações, impasses e benefícios das principais modificações em matéria processual inerentes ao direito de família, e evidenciar o impulso que o código processual traz à aplicação de novos métodos pacificadores de solução das demandas contenciosas no cenário jurídico-familiar.
