Based on bibliographic and documentary research, the structure of the fiscal administrative process is analyzed in Federal context and at the city of Araranguá and the conclusion according to the deductive comparative method is that both the legislatures offer tools that assure the adversarial and the legal defense. However, in the municipal context it is necessary to improve the mechanisms that ensure isonomy, impartiality and therefore, legal security.O presente trabalho monográfico busca, a partir da legislação, analisar o contencioso administrativo fiscal no âmbito Federal e no âmbito Municipal de Araranguá/SC, com o objetivo de compará-los, a fim de verificar se a estrutura legislativa é apta para implementar o contraditório e a ampla defesa, visto que, as discussões administrativas colocam pendentes uma parcela significativa de recursos públicos e que o acesso ao contencioso fiscal constitui direito fundamental do contribuinte.
