To this end, as a methodology the bibliographic research was used in laws, jurispru-dence, judgments, as well as the author's empirical knowledge, both as commander of aircraft, as investigator of aeronautical accidents by the Center for Investigation and Prevention of Aer-onautical Accidents of the Brazilian Air Force. It was analyzed what makes the judicialization of an occurrence a unique paradigm in the legal scenario. In this research I restricted myself to the criminal sphere of the legal process, showing the subtlety of the perilous crime that perme-ates aviation, and showing the omissive actions in the light of criminal law.O presente trabalho tem como objetivo verificar o espectro da judicialização dos acidentes e incidentes aeronáuticos na esfera penal, elucidando a repercussão do sinistro como também dos julgados decorrentes, e mostrando a tendência atual como também a futura. Para tanto, como metodologia se empregou a pesquisa bibliográfica em legislações, jurisprudências, julgados, por procedimento monográfico de natureza qualitativa e método dedutivo. Esta pesquisa apresenta a conceituação de acidentes e incidentes aeronáuticos, o que torna o direito aeronáutico um segmento tão único e com peculiaridades, e além disso todo o reflexo jurídico que um sinistro aéreo desencadeia. Foi analisado o que torna a judicialização de uma ocorrência num paradigma único no cenário jurídico.
