Hassan, Nádila da SilvaRosa, Talita Magnus2018-12-072020-11-272018-12-072020-11-272018https://repositorio.animaeducacao.com.br/handle/ANIMA/7590The present research has as its object family conflicts from the perspective of family constellations and systemic law, and its main objective is to demonstrate the functioning and applicability of the dynamics of the systemic constellations in the Brazilian family, as an instrument capable of providing the solution of the peaceful way and with the purpose of avoiding the recidivism of the parties to the conflict in the home and judicial environment. For the research, we used the bibliographic methodology and documentary research, searching the context of the problem, and the doctrinal conceptions. As a result of the analysis, it was observed that the judiciary shows a deficit with the overload of actions, being necessary the application of alternative and agile methods for the resolution of the cases and effectively to enable the litigants to the justice that seek. It presents the application of family constellations as one of the solutions in order to understand the origin of conflicts within the family, and allows the parties themselves to arrive at a resolution that best suits the case. Thus, it is demonstrated that family relations, even in the face of crises and conflicts, when understood by the members belonging and structurally organized, is able to preserve the living together in a healthy wayA presente pesquisa tem como objeto os conflitos familiares sob à ótica das constelações familiares e do direito sistêmico, e tem como objetivo principal demonstrar o funcionamento e aplicabilidade da dinâmica das constelações sistêmicas no âmbito familiar brasileiro, como instrumento capaz de proporcionar a solução da lide de forma pacífica e com o fito de evitar a reincidência das partes ao embate no meio domiciliar e judicial. Para a pesquisa, utilizou-se a metodologia bibliográfica e pesquisa documental, buscando o contexto do problema, e as concepções doutrinárias. Como resultado da análise, observou-se que o judiciário mostra-se deficitário com a sobrecarga de ações, sendo necessária a aplicação de métodos alternativos e ágeis para a resolução das lides e efetivamente possibilitar as partes litigantes à justiça que procuram. Apresenta-se a aplicação das constelações familiares como uma das soluções de forma a compreender a origem dos conflitos no âmbito familiar, e possibilita que as próprias partes cheguem uma resolução que melhor se adeque ao caso.
