Será apontado neste artigo questões relacionadas a identidade de gênero, a forma de tratamento oferecido, os direitos inerentes e as possíveis adequações tanto nas leis como no processo de prisão para a mulher trans. O artigo apontará as falhas e incoerências no sistema carcerário, dos maus tratos e abusos sofridos pelas mulheres transgêneros. Propalando sobre a legislação presente que não protege essa parcela da nossa sociedade, e que seja cumprida e busque novos e melhores horizontes para quem não tem o devido tratamento ou não está em lugar adequado ao gênero de fato e de direito.This academic article aims at in-depth study of the situation of transgender women in the Brazilian prison system and the violation of fundamental rights that are guaranteed to all Brazilians, including protection against degrading and inhumane acts.
