Para tanto, discute sobre a judicialização da saúde suplementar no Brasil; explica o papel da ANS junto aos planos de saúde suplementar, notadamente no que concerne à definição dos procedimentos que integram o seu rol; e pesquisa como o TJSC tem se posicionado com relação à controvérsia sobre a taxatividade dos procedimentos autorizados pela ANS. Trata-se de pesquisa bibliográfica e documental. No que tange aos instrumentos de coleta de dados utilizados, foi empregada a revisão bibliográfica em doutrinas e a pesquisa documental em legislações e entendimentos jurisprudenciais referentes ao tema eleito para análise. Para tanto foram selecionados os processos julgados no TJSC, entre os dias 07 de junho e 07 de novembro de 2022, com o propósito de elucidar se a decisão do STJ tem influenciado nas decisões deste Tribunal de Justiça.This article aim to analyze the reflexes of the understanding of the Superior Court of Justice (STJ) in the EREsp. 1,886,929 in the decisions handed down by the Court of Justice of Santa Catarina - TJSC between June 7 and November 7, 2022. To this end, it discusses the judicialization of supplementary health in Brazil; explains the role of the ANS with the supplementary health plans, notably with regard to the definition of the procedures that are part of its role; and research how the TJSC has positioned itself in relation to the controversy over the taxation of procedures authorized by the ANS. This is a bibliographic and documentary research. Regarding the data collection instruments used, a literature review on doctrines and documental research on legislation and jurisprudential understandings regarding the chosen topic for analysis were used.
