O estudo examinará o arcabouço jurídico internacional sobre o tema, verificando o risco de violação aos Direitos Humanos dessa nova categoria de refugiados. Serão exploradas as principais disposições jurídicas citadas no primeiro precedente envolvendo o reconhecimento de um refugiado climático perante o Comitê de Direitos Humanos da ONU. Por fim, como alternativa resolutiva, serão abordadas medidas unilaterais efetivas que foram criadas por Estados para estabelecer um instrumento jurídico de garantia dos Direitos Humanos daqueles que são obrigados a se deslocar por razões climáticas.This article seeks to analyze the lack of international legislation that gives protection to people displaced by environmental factors, currently called as climate refugees. The study will examine the international legal framework about the subject, it will verify the risk of violation of Human Rights of this new refugee category. It will explore the main legal provisions cited in the first legal precedent involving the recognition of a climate refugee before the UN Human Rights Committee.
