Trata-se de assunto de grande relevância no cenário mundial, tendo em vista a contraposição de forças por esse gerado entre os países desenvolvidos, detentores de tecnologia e exploradores da biodiversidade, e as nações menos desenvolvidas/em desenvolvimento, biologicamente megadiversas e abundantes em conhecimentos tradicionais e recursos genéticos. A fim de atingir os objetivos propostos, necessita-se de breve discurso sobre as possíveis formas de proteção da propriedade intelectual em âmbito internacional, contendo uma definição do que são os conhecimentos tradicionais e recursos naturais, de estudo acerca do direito internacional público, bem como suas fontes e sujeitos, e então de análise do posicionamento das organizações acima citadas em relação ao foco escolhido, assim como dos tratados internacionais que versam sobre o tema. Para tal, este trabalho de conclusão de curso possui como método objetivo a pesquisa qualitativa, sendo feito de forma bibliográfica e documental e dirigido pela pesquisa básica. O estudo mostra que, apesar do grande avanço que tem se mostrado na área através de discussões para que haja uma melhor proteção dos conhecimentos tradicionais e do patrimônio genético, há muito ainda para se trabalhar a fim de que se encontre um equilíbrio entre as aspirações e necessidades dos países megadiversos e daqueles portadores de biotecnologiaThis monografy has as its main interest to analise the international protection of the intellectual property, focusing the study on the protection of the traditional knowledge and genetic heritage by the aspect of the World Intelectual Property Organization and the World Trade Organization. It´s about a theme of great relevancy at the worldly scenario, had seen the opposition of forces created between the developed countries, detainers of technology and natural resources exploiters, and the less developed/developing nations, biologically megadiverses and abundant in traditional knowledge and genetic heritage. Willing to reach the objectives proposed, it´s needed a succinct discourse about the possible forms of intellectual property protection in an international ambit containing a definition of what are the traditional knowledges and natural resources, a study about the public international law, as well as it´s sources and subjects, and then an analysis about the position of the organizations mentioned above in relation to the focus chosen, just like of the international treaties that deal with the theme. To that, this Conclusion Work has as its aim method the qualitative research, been done in a bibliographic and documental way and guided by basic research.
