The goal is to trace a line of causes and effects, demonstrating the direct link that exists between a prison crisis and an exponential increase in street violence, as well as reinforcing the need for direct intervention by the judiciary. The conclusion was that the judiciary can, and should, intervene when necessary to protect fundamental rights, such as the “state of unconstitutional things” instrument is legit in the face of violations observed in the prison system. The methodology used was bibliographic and documentary research, website information, legal magazines and own legislation, so that it can demonstrate the need for intervention by the judiciary in solving problems.Esta pesquisa trata dos direitos fundamentais lesados dentro do sistema prisional brasileiro, apontando o “Estado de Coisas Inconstitucional”, bem como a atuação extensiva do Poder Judiciário, como principais meios de resolução para o problema. O objetivo é traçar uma linha de causas e efeitos, demonstrando o vínculo direto que existe entre a crise carcerária e o aumento exponencial de violência nas ruas, bem como reforçar a necessidade de intervenção direta do Poder Judiciário.
