O conflito dentro do Oriente Médio, por muitos, é visto como atemporal, pois se estende pela história. Por sua vez, os conflitos desta região passaram a tomar proporções internacionais a partir do Século XIX, com a interferência da Europa, na nova divisão territorial do Oriente Médio, feita pelos ingleses e franceses. Os conflitos árabes-israelenses passaram a ocorrer, e a se intensificar, nos moldes que conhecemos hoje, desde então. As divergências principiológicas e os objetivos de Palestina e Israel fez com que o Direito Internacional intervisse assiduamente na situação desde 1947, com a atuação da ONU. Neste trabalho, ocorre a análise histórica dos conflitos árabe israelense, bem como o papel do Direito Internacional no conflito desde sua exordial, e como ocorre a atuação do Tribunal Penal Internacional frente a um dos mais longos, e conhecidos, conflitos entre duas regiões que sucedeu diversos crimes contra a humanidade.Historically, the humanity went through huge international conflicts, which were developed by divergency in the goals between the parts involved. The Middle East conflict it’s seen as being atemporal once it is extended in the history. The conflicts in that region took an international path since Sec. XIX when Europe redistributed the Middle East’s states between European States and redesigned all the borders. The Arabic-israeli conflicts took place since then. The principledly divergence and the intent of Palestine and Israel suffered interference from International Law and the UN since 1947.
