In order to do so, the following research methods were adopted: as regards the approach, it was classified as qualitative, as far as level is concerned, the research is exploratory and the procedure adopted has the bibliographic. With the study, it was found that when including transgender individuals in penitentiary different from their gender identity is to promote social segregation, promoting a double penalty, through exposure in vexatious and humiliating situations. Legislative evolution is evident in protecting and highlighting that part of the population that is so vulnerable, but in the midst of the chaotic scenario of the prison, there is still an urgent need to apply effective public policies to safeguard and protect social, physical and moral rights of transgender individuals.A presente pesquisa monográfica tem por objetivo analisar o cumprimento da pena privativa de liberdade por transgêneros. Para tanto, adotou-se os seguintes métodos para a pesquisa: quanto à abordagem, foi classificada como qualitativa, quanto ao nível, a pesquisa é exploratória e quanto ao procedimento adotado tem-se o bibliográfico. Com o estudo, constatou-se que ao incluir indivíduos transgêneros em penitenciária diversa de sua identidade de gênero é promover a segregação social, além de uma dupla penalidade, através da exposição em situações vexatórias e humilhantes.
