Para tanto, procedeu-se de uma pesquisa bibliográfica com o intuito de encontrar autores e obras que melhor respondessem aos objetivos do estudo. Compreendeu-se que dentro das instituições militares a obediência hierárquica é demanda essencial e indispensável para a manutenção da ordem e da força de atuação da organização. Além disso, é essencial a obediência das normas e padrões estabelecidos legalmente, incluindo-se o Corpo de Bombeiros no rol dessas instituições. A omissão é vista não como uma ação, mas ao contrário, deixar de agir frente a uma situação na qual o indivíduo poderia ou deveria fazê-lo. Pode ocorrer que o Bombeiro Militar venha a omitir-se de agir em algumas situações, incorrendo em crime omissivo próprio ou impróprio. Enquanto o crime omissivo próprio refere-se à omissão diante de ocorrências específicas de sua atuação, como no caso de deserção, na omissão imprópria o Bombeiro Militar omite-se de fazer algo que lhe é devido por meio de instituto jurídico. Diante do dever de evitar uma situação como sendo seu papel dentro do Corpo de Bombeiros, o Bombeiro Militar que se omite de fazê-lo permite que ocorra um fato que poderá apresentar consequências graves, como acidentes e mesmo a morte do indivíduo, o que poderá levar o Bombeiro Militar a responder pelo resultado, como se agido tivesse.The present paperwork was conducted aiming to increase the student understanding about improper omission crimes in the activity of military firefighters. For this, it was proceeded a bibliographical research aiming to find authors and works that would better answer to the aims of the paperwork. It was understood that inside the military institutions hierarchic obedience is an essential demand, essential to the maintenance of order and strength in the work of the organization. Besides, it is needed to obey norms and patterns legally established, including the Fire Department in the frame of those institutions. Omission is seen not as an action, but in the opposite way, as the lack of action in a situation in which the subject could or should do it. It can happen that the military firefighter comes to omit themselves in some situations, incurring in proper or improper omission crime. As well as proper omission crime refers to omission in specific occurrences in their acting, in the improper omission the Firefighter omits of doing something that is their obligation through the legal system.
