Para tanto, busca-se compreender o legítimo interesse na proteção dos dados pessoais e o tratamento conferido pelo legislador. Parte-se da premissa de que o legislador não consegue prever todas as situações em que se aplica determinada norma, o que ganha relevo em se tratando de dados pessoais e as novas tecnológicas. Diante da constante inovação, o legítimo interesse apresenta-se como elemento flexibilizador, a autorizar o tratamento de dados por controlador ou terceiro interessado, ainda que inexista consentimento do titular dos dados. Contudo, a questão não é simples, seja porque o conceito de legítimo interesse é amplo, seja porque nem sempre é fácil conciliar interesses, principalmente no que diz respeito às expectativas do titular de dados.
