To achieve this goal, the deductive approach was used, starting from a doctrinal overview, and then searching for written norms to demonstrate how sanctions are applied to the homicidal psychopath and to verify the functionality of the Resocialization Program. The problems faced, to evaluate whether the distressed psychopath is ressocialized or not after the fulfillment of the sentence and return to commit illicit acts again. The study found that the types of sanctions applied to homicidal psychopaths are not very effective, since they end up mostly recidivist. Thus, it is concluded that there is a great precariousness in the judicial system about the effectiveness of punishment and resocialization of those with mental disorders. Keywords: Criminal law. Resocialization.O trabalho focaliza a ressocialização do psicopata homicida, cujo objetivo geral é analisar e verificar as possíveis relações jurídico-estatais que viabilizam a ressocialização e a inserção do detento psicopata homicida na sociedade. Para alcançar tal objetivo foi utilizado o método de abordagem dedutivo, partindo de uma visão geral doutrinária e, após, buscando em normas escritas com o fim de demonstrar como são aplicadas as sanções ao psicopata homicida e verificar a funcionalidade do Programa de Ressocialização; identificar os problemas enfrentados; avaliar se o apenado psicopata sai ressocializado ou não após o cumprimento da pena e se voltam a cometer atos ilícitos novamente. Do estudo constatou-se que, os tipos de sanções aplicadas aos psicopatas homicidas, não são de grande eficácia, pois acabam em grande maioria reincidindo. Assim, conclui-se que existe uma grande precariedade no sistema judiciário sobre a eficácia da punibilidade e ressocialização desses psicopatas homicidas. Palavras-chave. Direito penal. Psicopata.
