The proposed theme was developed in five chapters. First, the subject was introduced, emphasizing its importance. Afterwards, considerations were made about the family in the Brazilian legal order, listing the principles related to the theme, such as the dignity of the human person, the integral protection of children and adolescents, the best interests of children and adolescents, affectivity, solidarity and family life, responsible parenting and the search for happiness. In the third chapter, an approach was made about civil liability, bringing, at first, the historical evolution of the institute and, later, its elements, emphasizing contractual and non-contractual, objective and subjective civil liability. The fourth chapter dealt with the central theme proposed, discussing the civil liability of parents for the emotional abandonment of their children. The existing Draft Laws on the matter were narrated and, then, the arguments used by the Superior Court of Justice were favorable and opposed to reparation for emotional abandonment. At the end, the fifth chapter presented the final considerations about the present work of conclusion of course.O presente trabalho tem por objetivo analisar a responsabilidade civil por abandono afetivo do filho de acordo com entendimento do Superior Tribunal de Justiça. O tema proposto foi desenvolvido em cinco capítulos. Primeiramente, introduziu-se o assunto, enfatizando sua importância. Após, fez-se considerações acerca da família na ordem jurídica brasileira, elencando os princípios relacionados ao tema, como a dignidade da pessoa humana, a proteção integral da criança e do adolescente, o melhor interesse da criança e do adolescente, afetividade, solidariedade e convivência familiar, paternidade responsável e busca pela felicidade. No terceiro capítulo se fez uma abordagem acerca da responsabilidade civil, trazendo, em um primeiro momento, a evolução histórica do instituto e, depois, os seus elementos, enfatizando a responsabilidade civil contratual e extracontratual, objetiva e subjetiva. O quarto capítulo tratou do tema central proposto, discorrendo-se sobre a responsabilidade civil dos pais pelo abandono afetivo dos filhos. Foram narrados os Projetos de Lei existentes sobre a matéria e, então, elucidou-se os argumentos usados pela Corte Superior de Justiça favoráveis e contrários à reparação por abandono afetivo.
