Approaches, also, the form and the moment of argument about the executive nullities, passing from the typical means to the atypical means of execution, including the pre-executive exception, addressing its requirements and forms of interposition, as well its effect on executions. The method of approach is the deductive thinking, starting from the general discussion about the execution and the means of defense of the executed to arrive at the specific and qualitative discussion about the exception of pre-executive. The research technique used is the bibliographical one, based on doctrine, legislation and jurisprudence. The pre-executive exception does not have an express provision in the Brazilian legal system, but it is possible to apply it. Keeywords: Enforcement. Defence. Executivity.O presente artigo trata de exceção de pré-executividade, com o objetivo de estudar a aplicação do instituto perante o CPC vigente, abrangendo as nulidades nas ações executivas, passando pelo título executivo, ao procedimento executório, abordar a forma e momento de arguição das nulidades executivas, passando desde os meios típicos aos meios atípicos da exceção de pré-executividade, abordando seus requisitos e formas de interposição, bem como seu efeito nas execuções. O método de abordagem é o de pensamento dedutivo, partindo da discussão geral sobre a execução e os meios de defesa do executado para chegar à discussão específica exceção de pré-executividade, de natureza qualitativa. A técnica de pesquisa utilizada é a bibliográfica, com base na doutrina, legislação e jurisprudência.
