For preparation, in relation to the level or objectives, the exploratory mode was used, considering a familiarity provided to the problem. To the development, a qualitative approach has been applied, in order to demonstrate the real and peculiar aspects of the theme. Regarding the research procedure, data collection has been used, resorting bibliographic sources, especially doctrines. Furthermore, essential to emphasized that proper legislation and jurisprudential understandings has been used to support the monograph. Thereby, the final understood was that is legally possible for solidarity debtor assume to the active pole, as long as there is a full payment of the debt, considering the supervening active legitimacy.O objetivo deste trabalho acadêmico é analisar a possibilidade e a forma de assunção do devedor solidário ao polo ativo no cumprimento de sentença na hipótese de pagamento integral da dívida, em razão do direito de regresso. Para elaboração, no que se refere ao nível ou objetivos, utilizou-se o modo exploratório, considerando a familiaridade proporcionada ao problema. Quanto à abordagem, aplicou-se a forma qualitativa, a fim de demonstrar os aspectos reais e peculiares ao tema. No que tange ao procedimento de pesquisa, foi utilizada a coleta de dados, trabalhando-se com fontes bibliográficas, especialmente doutrinas. Ademais, ressalta-se que foram utilizadas as legislações pertinentes e entendimentos jurisprudenciais para o embasamento da monografia.
