Ademais, cumpre destacar que o estudo também abordará sobre o Sistema Único de Saúde e sobre os privilégios da efetivação da assistência pública a saúde através do Poder Judiciário.This essay aims to analyze the exponential growth of the judicialization of health. The analysis will focus on the seek of the Judiciary to guarantee the fundamental right provided by Article 196 of the CRFB/88. Are judicial determinations essential instruments for making public health care effective? The research also aims to observe the implementation of public policies through the Judiciary without the prior approval of the Executive Branch, highlighting a possible usurpation of competence between the Branches of the State.
