The bail payment, for debt settlement, is a kind of legitimate down payment. What many of those involved do not consider, it is for the need of the grantee to inform such fact at the time of the opening of the succession. This information is called collation. When unrealized, it may harm other heirs, who will receive less than they are entitled to. These, will, have the right to request that the necessary heir (donate) inform the value of the goods received from the common ascendant. It happens that with the death of the donor, there will be a deadline for heirs who feel prejudiced, seek the judiciary for a solution to match the value of inheritance / legitimate belonging to all heirs. Failure to do so within a certain period, will occur the prescription, and there may be litigation on the matter. Quando não realizado, poderá prejudicar os demais herdeiros, que receberão menos do que têm direito. Esses, por sua vez, têm o direito de requererem que o herdeiro necessário (donatário) informe o valor referente aos bens que recebeu do ascendente comum. Ocorre que, com a morte do doador, haverá um prazo para que os herdeiros que sentirem-se prejudicados, busquem o judiciário para uma solução de igualar o valor da herança/legítima pertencente a todos os herdeiros. Não o fazendo em determinado prazo, ocorrerá a prescrição, não mais podendo haver litígio sobre a matéria.
