METHOD: Regarding the level, the research is exploratory, because it aims to identify which are the positions that raise or not the affectivity to the basic principle of the family. Regarding the approach used, the method was qualitative. The procedures employed were bibliographic and documentary research. RESULTS: The plurality of contemporary relationships gives rise to the most diverse family groups. In this regard, the legal system does not follow changes in society, so that some of the current demands of family law find no solution in law, but in the doctrinal and jurisprudential interpretation of the main application. Given this, regarding the institute of affiliation, affectivity has great relevance, being used as a criterion by the judiciary in the analysis of the specific case. CONCLUSION: Affectivity is a fundamental element in the analysis of kinship relations because the current family configurations are based on the mutual feelings that their members have for each other.OBJETIVO: Analisar a afetividade como princípio fundamental na constituição das relações paterno-filiais no ordenamento jurídico brasileiro. MÉTODO: Quanto ao nível, a pesquisa é exploratória, pois visa identificar quais são os posicionamentos que alçam, ou não, a afetividade à princípio basilar da família. No que concerne à abordagem utilizada, o método foi qualitativo. Os procedimentos empregados foram a pesquisa bibliográfica e documental. RESULTADOS: A pluralidade de relacionamentos contemporâneos faz com que surjam os mais diversos conjuntos familiares. Nesse viés, o ordenamento jurídico não acompanha as mudanças da sociedade, fazendo com que algumas das atuais demandas do Direito de Família não encontrem solução na lei, mas sim na interpretação doutrinária e jurisprudencial da aplicação principiológica. À vista disso, no que concerne ao instituto da filiação, a afetividade tem grande relevância, sendo utilizado como critério pelo judiciário na análise do caso concreto.
