O tema é importante em função da atual discussão sobre o episódio, especialmente em relação à conduta do motorista que deu causa ao estupro. Assim, analisou-se a possibilidade da aplicação da Teoria da Imputação Objetiva de Roxin para apurar a responsabilidade criminal do motorista. O objetivo geral verificou se o motorista pode responder objetivamente pelo crime de estupro. Para tal, foi abordada a teoria, constatada a teoria adotada pelo Código Penal e o entendimento do Superior Tribunal de Justiça. Realizou-se a apreciação dos crimes de estupro e estupro de vulnerável. O estudo de caso tratou do dever de cuidado e da aplicação da teoria à conduta do motorista. Por meio da metodologia estudo de caso e pesquisa bibliográfica obteve à conclusão de que o motorista não poder responder de forma objetiva pelo crime de estupro. Porque o risco criado e concretizado pela sua conduta gerou um resultado típico diverso.This article discusses the rape incident involving the young woman who was left unconscious on her ride by a ride-hailing app driver in Belo Horizonte. The topic is important due to the current discussion about the episode, especially in relation to the conduct of the driver that caused the rape. Thus, the possibility of applying Roxin's Objective Imputation Theory to determine the driver's criminal responsibility was analyzed. The general objective was to verify whether the driver could respond objectively for the crime of rape. To this end, the theory was addressed, the theory adopted by the Penal Code and the understanding of the Superior Court of Justice were verified. The crimes of rape and rape of a vulnerable person were assessed. The case study dealt with the duty of care and the application of the theory to the driver's conduct.
