O Estatuto de Roma criou o Tribunal Penal Internacional e fez surgir a preocupação quanto à integração das matérias apreciadas pela Corte e os ordenamentos jurídicos de cada nação. Os objetos deste artigo são os entraves e as compatibilidades existentes entre o Estatuto do Tribunal Penal Internacional e o ordenamento jurídico brasileiro. Para tanto, faz-se necessária a análise da aplicabilidade das decisões proferidas por essa Corte perante a Constituição da República de 1988, o Direito Penal e Processual Penal pátrios. A partir desta acareação legislativa e doutrinária, objetiva-se verificar a constitucionalidade e eficiência da aplicabilidade das decisões proferidas pelo Tribunal Penal Internacional no ordenamento jurídico brasileiro.Since the proclamation of the Universal Declaration of Human Rights, much has been discussed about the creation of an International Court that would guarantee the application of these rights throughout the world. The Rome Statute created the International Criminal Court and raised concerns about the integration of matters considered by the Court and the legal systems of each nation. The objects of this article are the obstacles and compatibilities that exist between the Statute of the International Criminal Court and the Brazilian legal system. Therefore, it is necessary to analyze the applicability of the decisions uttered by this Court before the Constitution of the Republic of 1988, the country's Criminal Law and Criminal Procedure.
