To this end, the following research methods are adopted: as to the approach, qualitative; as for the level, exploratory; and, regarding the data collection procedure, bibliographic and documentary, since it will use referenced doctrine, as well as dispersed legislation and also, the Terms of Use of the Liberfly application. It was verified in this undergraduate thesis that, the Liberfly app acts according to all the established guidelines of the Consumer Protection Code and it is compatible with the current legislation. As well, considering that most passengers, when faced with an air casualty situation, choose not to require their privileges, either due to lack of knowledge or time, and Liberfly, in these cases, proves to be a useful resource. bearing in mind that the airline should be held responsible.A presente monografia tem como objetivo principal analisar sob o aspecto jurídico o contrato realizado entre o aplicativo e o passageiro a fim de averiguar a viabilidade da indenização aérea pretendida à luz do Código de Defesa do Consumidor. Para tal adotam-se os seguintes métodos de pesquisa: quanto à abordagem, qualitativa; quanto ao nível, exploratória; e, quanto ao procedimento de coleta de dados, bibliográfica e documental, visto que se utilizará de doutrina referenciadas, bem como de legislações dispersas e ainda, os Termos de Uso do aplicativo Liberfly. Verificou-se nesse trabalho que, o aplicativo Liberfly atua conforme todas as diretrizes estabelecidas Código de Defesa do Consumidor e que se mostra compatível com a legislação atual.
