One of the fronts on this search includes the quality of the law which regulates the air transport activity and the aplicability of the law to penalize the offenders. This text compares the previous Aeronautics’ Board of Trial regulation, Ordinance #9/DGCEA and the current regulation, Ordinance #258/JJAER to evaluate the role of this new regulation on the aviation safety. The conclusion is that the new ordinance led to a significant increase on the levels of operational safety.A indústria da aviação busca incansavelmente a diminuição do número de acidentes e a redução da gravidade dos acidentes que fatalmente venham a ocorrer. Uma vertente desta busca inclui a qualidade das normas que regulamentam e que atividade de transporte aéreo e a aplicabilidade das normas que são utilizadas para penalizar os infratores. Neste trabalho são comparadas a regulamentação anterior da Junta de Julgamento de Aeronáutica, Portaria no 9/ DGCEA, e a regulamentação atual, Portaria DECEA no 258/JJAER, com o objetivo de determinar o impacto da nova regulamentaçao na segurança operacional da aviação.
