Nesse sentido, o sistema de freios e contrapesos implícito em sua formulação, veio a contribuir efetivamente para essa relação harmoniosa de poder. Não obstante, as crescentes demandas que buscam garantias fundamentais ao Poder Judiciário é um fenômeno vivido pelos mais diferentes países, e no Brasil ele se apresenta, muitas vezes, como uma solução aos anseios da sociedade frente à inércia dos demais poderes. Com esse estudo buscou-se analisar a doutrina da separação dos Poderes, do sistema de freios e contrapesos bem como, a crescente atuação da Corte Constitucional Brasileira em áreas típicas dos outros poderes.The current Constitution of the Federative Republic of Brazil, promulgated in 1988, underpinned the tripartition of the Powers of the Republic, keeping them independent and in harmony with each other. In this sense, the system of checks and balances implicit in its formulation, came to contribute effectively to the harmonious relationship of Power. The growing legal demands seeking fundamental guarantees to the Judiciary Power is a phenomenon that occurs in many countries. In Brazil it is often presented as a solution to society's concerns in the face of the inertia of the other Powers of the Republic.
