Pretende-se analisar a constitucionalidade da Emenda Constitucional nº 96/17, a possível existência do efeito backlash sobre a matéria e a viabilidade do meio ambiente ser considerado uma cláusula pétrea. Assim, o presente trabalho estuda o Direito ao Meio ambiente e o Direito à cultura, analisando-os como direitos fundamentais na perspectiva da Constituição federal de 1988, e a maneira que eles impactam a temática da vaquejada, à luz da constitucionalidade desta prática. Analisados os aspectos constitucionais, é possível compreender que, apesar da vaquejada possuir notável relevância cultural, é inadmissível que tal prática infrinja o Direito a um meio ambiente seguro e equilibrado, aspecto essencial para uma existência digna.This research seeks to highlight the collision of fundamental rights present in Vaquejada, a sports practice that uses animals, and possibly deduce which should prevail, discussing its cultural and environmental aspects, and discussing the fundamentals of the Right to Environment and the Right to Culture. It intends to analyze the constitutionality of Constitutional Amendment No. 96/17, the possible existence of the backlash effect on the matter, and the feasibility of the environment being considered a stony clause. Thus, the present work studies the Right to Environment and the Right to Culture, analyzing them as fundamental rights from the perspective of the Federal Constitution of 1988, and the way they impact the theme of vaquejada, in light of the constitutionality of this practice.
