The performance of the academic in the Military Police was fundamental for the choice of the theme, since there was an area where the police action could make more effective the fulfillment of the sentences and, with that, reduce the number of criminal recidivism. In order to achieve this aim, bibliographical and documentary research was carried out and, based on the comparative method, the numbers obtained through the criminal inspections carried out by the Military Police in Garopaba, a municipality where there was a Judiciary for this purpose, were analyzed using the police approach Carried out in the municipality of Tubarão, where there is no standard procedure for the case of flagrante delicto, failing to comply with conditions established by the Court of Execution.Este trabalho monográfico possui como objetivo principal comparar os procedimentos adotados pela Policia Militar de Santa Catarina, nos municípios de Garopaba e Tubarão, no ano de 2016, quando em contato com apenados que gozam de benefícios concedidos pela Lei de Execução Penal, como as Saídas Temporárias, Livramento Condicional ou cumprimento de pena em Prisão Albergue ou Domiciliar. A atuação do acadêmico na Polícia Militar foi fundamental para a escolha do tema, pois verificou-se um espaço onde a atuação da polícia pode tornar mais efetivo o cumprimento das penas e, com isso, reduzir o número da reincidência criminal. Para atingir este fim, foram realizadas pesquisas bibliográfica e documental e, a partir do método comparativo, foram analisados os números obtidos por meio das fiscalizações penais realizadas pela Polícia Militar em Garopaba, município onde existe parecia com Judiciário para este fim, com as abordagens policiais realizadas no município de Tubarão, onde não há um procedimento padrão para o caso de flagrância de apenado descumprindo condições estabelecidas pelo Juízo da Execução.65 folhaspt-BRAttribution-NonCommercial-NoDerivs 3.0 BrazilLei de Execução Penal.
