A pergunta-problema indagou sobre o entendimento desses Tribunais acerca da responsabilização civil nesse contexto. A pesquisa empregou métodos dedutivos, bibliográficos e documentais, estabelecendo relações lógicas de forma qualitativa. Perante a análise abrangente realizada ao longo dos capítulos desta monografia, foi possível concluir e responder a pergunta, afirmando que a responsabilidade dos filhos em prestar assistência aos pais idosos é imperativa, fundamentada em princípios éticos e jurídicos essenciais, como a solidariedade e a dignidade da pessoa humana. A tutela jurídica dessa relação paterno-filial é crucial, mas a avaliação das circunstâncias envolvidas deve ser feita com cautela pelos Tribunais. Dessa forma, a harmonização entre a responsabilidade individual e a atuação do sistema judicial é vital para assegurar o bem-estar e a dignidade das pessoas idosas, promovendo relações entre pais e filhos mais justa e solidáriaThis course conclusion work aimed to understand the position of the Courts of Justice in the South of Brazil in relation to the responsibility of children who emotionally abandon their elderly parents. The problem question asked about the understanding of these Courts regarding civil liability in this context. The research used deductive, bibliographic and documentary methods, establishing logical relationships in a qualitative way. Given the comprehensive analysis carried out throughout the chapters of this monograph, it was possible to conclude and answer the question, stating that the responsibility of children to provide assistance to elderly parents is imperative, based on essential ethical and legal principles, such as solidarity and dignity of human person. The legal protection of this paternal-filial relationship is crucial, but the assessment of the circumstances involved must be carried out with caution by the Courts.
