Monografia Acesso aberto Integralização de capital social e a outorga uxória: (in)exigibilidade de ato específico por cônjuge casado com sócio em regime de comunhão universal de bens(2019) Bolan, Geovana RaulinoThe main theme of the present research is multidisciplinary, permeating Business Law and Civil Law. We sought to analyze the appropriate form for the granting of the award in the act of paying up the capital stock of the limited company, when performed by a married partner under a universal communion of goods. Initially, the so-called “Sociedade Empresarial” (Business Society), which operates under the limited regime, was addressed - with emphasis on the historical part, main concepts, classifications and in particular (as the central theme of this paper), the doctrinal treatment of social capital and its full payment. With regard to the branch of Family Law, the concept of marriage, legal nature, existing regimes in the Brazilian legal system was addressed, emphasizing the regime of universal communion of goods. Being analyzed the central themes for each branch of the law, the research finally sought to develop the central theme, namely: the payment of social capital and the granting: (un) enforceability of a specific act by a spouse married to a partner in universal communion regime of goods. To develop the theme, the main arguments presented by the doctrine and jurisprudence were mirrored, emphasizing the divergence that this theme brings to the present time. The research, without pretending to exhaust the subject, and based on the judicial and doctrinal divergences, presents the basic values of each one of the branches, with a view to extracting, from each of the strands, its arguments and considerations and thus contributing to depart from the current one. legal uncertainty about the issue. The method of monographic and comparative procedure was used, including books, articles, jurisprudence. As for the approach, it was deductively based on an exploratory research, using primary sources as bibliographic and documentary research as data collection. The present work was divided into four chapters, in order to achieve all the proposed objectives.
