Resumo
O trabalho a seguir é uma análise sobre o procedimento arbitral nas relações comerciais internacionais baseada na legislação brasileira de arbitragem, a lei nº 9.307/96, assim como a maneira que a arbitragem internacional está presente no ordenamento jurídico brasileiro. Na primeira etapa da pesquisa está desenvolvido um escorço histórico e social no qual a arbitragem está ou esteve inserida. Após o estudo dos preceitos históricos e sociais da arbitragem, foi realizado uma análise dos principais pontos da lei nº 9.307/96, que rege sobre a arbitragem no Brasil. Logo, é realizado um estudo sobre a jurisdição e o acesso à justiça. E ao final, adentra-se na questão das vantagens da arbitragem sobre a jurisdição estatal
The following work is an analysis about the arbitral procedure in the international trade relations based on the Brazilian arbitration legislation, thelaw no. 9.307/96, as well as in the international agreements present in the Brazilian legal system. In the first phase of the research it is developed all at the social and historical chart in which the arbitration is or has been inserted. After studying thehistorical and socialprecepts of arbitration, an analysis of the main points of the law no. 9.307/96 was held, which governs arbitration in Brazil.Thus,we conducted astudy on thejurisdiction and accessto justice.In the end, we go deep in the advantages from the arbitration above the state jurisdiction
