dc.description.abstractO presente trabalho de monografia trata da Lei do Superendividamento, o Mínimo Existencial e a correlação entre o endividamento e a insolvência civil. Primeiramente é feita uma abordagem materialista e histórica quanto ao direito do consumidor no mundo e no Brasil, seu desenvolvimento, proteção, sua amplitude e necessária modificação perante as mudanças sociais detidas no século XXI, e a afirmação de conceitos que levaram a efetividade de sua projeção e inovação. Posteriormente, define-se a insolvência civil e sua correlação perante a lei do superendividamento, que trouxe proteção ao consumidor superendividado, analisando sua aplicabilidade no contexto social brasileiro e a desenvoltura dos conceitos ali compreendidos para a população frágil e vulnerável de consumidores. Então, desenvolve-se o questionamento perante o conceito de mínimo existencial, pertencente à Constituição Federativa Brasileira, aos pilares fundamentais da legislação e o consumidor na sociedade atual, interligando os conceitos abordados no decorrer do trabalho. Concluindo com a efetividade da lei n° 14.181/22 e sua desenvoltura no momento atual da competência legislativa brasileira.pt
dc.description.abstractThis monograph deals with the Law of Over-indebtedness, the Existential Minimum and the correlation between indebtedness and civil insolvency. Firstly, a materialistic and historical approach is taken regarding consumer rights in the world and in Brazil, its development, protection, its scope and necessary modification in the face of the social changes held in the 21st century, and the affirmation of concepts that led to the effectiveness of its projection and innovation. Subsequently, civil insolvency is defined and its correlation with the over-indebtedness law, which brought protection to the over-indebted consumer, analyzing its applicability in the Brazilian social context and the resourcefulness of the concepts understood there for the fragile and vulnerable population of consumers. Then, the questioning is developed before the concept of existential minimum, belonging to the Brazilian Federative Constitution, to the fundamental pillars of the legislation and the consumer in the current society, interconnecting the concepts approached in the course of the work. Concluding with the effectiveness of law n° 14.181/22 and its resourcefulness in the current moment of the Brazilian legislative competence.en
