dc.description.abstract	This study aims to analyze the hypotheses of review, through Bill of Review (Agravo de Instrumento), listed on the article 1.015 of the Civil Procedure Code, in order to verify whether it is exhaustive or indicative, and still, if it is exhaustive, the possibility of extensive interpretation. That is because a recente decision made by the Superior Court of Justice (Superior Tribunal de Justiça) – Resp n. 1.679.909/RS – concerning that list, which was until then understood as limitative, admitted the possibility of extensive interpretation. Currently, the issue has not been decided by the Supreme Court (Supremo Tribunal Federal), for it is the object of appreciation on a “Recurso Especial Repetitivo” (Repetitive Special Appeal), under the number 988, bringing up great discussions to the judicial world, especially the legal unceartainty that potential admission of extensive interpretation may trigger in the Brazilian legal order. The conclusion of the study indicated that, among the three existing doctrinal understandings, the one that best fits the will of the legislator is that of the exhaustive list, otherwise there would be violation of the democratic process, which would cause discredit to the will of the legislator.	en
dc.description.abstract	O estudo em tela tem o fito de analisar as hipóteses de recorribilidade, via Agravo de Instrumento, estampadas no art. 1.015 do Código de Processo Civil, para verificar se o respectivo rol é exemplificativo ou taxativo, e ainda, sendo taxativo, se há possibilidade de interpretação extensiva. Isso porque, em recente julgado emitido pelo Superior Tribunal de Justiça, no REsp n. 1.679.909/RS, ao referido rol, que até então estava sob a égide do princípio da taxatividade, foi admitida interpretação extensiva. Atualmente, a questão ainda não foi decidida pela Corte de Cidadania, pois está afetada como matéria de Recurso Especial Repetitivo, sob o tema n. 988, trazendo ao universo jurídico grandes discussões acerca da questão, especialmente, a insegurança jurídica que eventual admissão de interpretação extensiva poderá trazer ao ordenamento jurídico brasileiro. O desfecho do estudo indicou que dentre os três entendimentos doutrinários existentes, o que melhor se alinha com a vontade do legislador é a de que o rol do artigo 1.015 é taxativo, sob pena de eventual leitura exemplificativa ou extensiva, ultrajar o processo democrático, o princípio da taxatividade, e, consequentemente, desprestigiar a vontade do legislador ao editar a norma.	pt_BR
