| dc.description.abstract | Este estudo busca examinar as implicações da nova Lei de Abuso de Autoridade (Lei no 13.869, de 2019) no exercício das funções da Polícia Militar. Utilizou-se para tanto uma metodologia de revisão bibliográfica, explorando diferentes interpretações doutrinárias. O trabalho foi estruturado em três capítulos principais: o primeiro e o segundo delineou a trajetória histórica do conceito de abuso de autoridade; o terceiro e último dedicou-se ao exame das raízes históricas das Polícias Militares no Brasil, abordando seu enquadramento constitucional e a importância social de seu papel e também centrou-se nos impactos práticos (delimitados aos artigos 13 e 22 da Nova Lei de abuso de Autoridade) que a nova legislação tem sobre o dia a dia da corporação policial militar. Este estudo proporcionou uma compreensão aprofundada das mudanças legislativas e de sua aplicação prática no contexto da segurança pública. Foi constatado que o conhecimento aprofundado da lei e a adoção de práticas operacionais condizentes são fundamentais para que o policial militar exerça suas funções dentro dos parâmetros legais, evitando atitudes que possam ser caracterizadas como abuso de autoridade. Tais práticas também se mostram cruciais para garantir a segurança jurídica necessária na tomada de decisões, assegurando a licitude das ações policiais. Assim, o estudo conclui que a atualização e capacitação contínua dos policiais quanto à nova legislação são medidas indispensáveis para a correta execução de suas atribuições e para a proteção dos direitos civis. | pt |
| dc.description.abstract | This study seeks to examine the implications of the new Law on Abuse of Authority (Law no 13.869, of 2019) on the exercise of the functions of the Military Police. For this purpose, a bibliographic review methodology was used, exploring different doctrinal interpretations. The work was structured into three main chapters: the first and second outlined the historical trajectory of the concept of abuse of authority; the third and last was dedicated to examining the historical roots of the Military Police in Brazil, addressing their constitutional framework and the social importance of their role and also focused on the practical impacts (delimited to articles 13 and 22 of the New Law on abuse of Authority) that the new legislation has on the day-to-day operations of the military police corporation. This study provided an in-depth understanding of legislative changes and their practical application in the context of public security. It was found that in-depth knowledge of the law and the adoption of consistent operational practices are fundamental for the military police officer to carry out their duties within legal parameters, avoiding attitudes that could be characterized as abuse of authority. Such practices are also crucial to guarantee the necessary legal certainty in decision-making, ensuring the lawfulness of police actions. Thus, the study concludes that the continuous updating and training of police officers regarding the new legislation are essential measures for the correct execution of their duties and for the protection of civil rights. | en |
