dc.description.abstractThe aim of this paper is to study the performance of the legal process in the face of the new provisions inserted in the Civil Procedure Code of 2015. It seeks to understand whether the creation of the legal business, as a pact between the parties, before or during the process, intended by the legislator as a way to provide a better procedural performance, fulfills its function. Thus, the flexibilization of the law, permeated by constitutional limits, had been researched in order to ascertain if the institute is advantageous and safe in a bilateral way. Therefore, a brief examination is presented on the attribution of the magistrate as collaborator in the execution of the agreements of this nature. In order to do so, some aspects are ensured such as the emergence of the legal transaction process, the procedure for its application, observing the limits of the powers for self-composition between the parties, from the legislation and doctrinal concepts of this institute.en
dc.description.abstractEste trabalho visa estudar a realização do negócio jurídico processual frente às novas disposições insertas no Código de Processo Civil de 2015. Busca compreender se a criação do negócio jurídico, como pacto entre as partes, antes ou no curso do processo, pretendida pelo legislador como forma de propiciar um melhor rendimento processual, cumpre sua função. Neste sentido, fora pesquisada a flexibilização da lei, permeada pelos limites constitucionais, no intuito de averiguar se o instituto se apresenta vantajoso e seguro de forma bilateral. Por conseguinte, apresenta-se um breve exame sobre a atribuição do magistrado como colaborador na efetivação dos acordos desta natureza. Para tanto, verifica-se o surgimento do negócio jurídico processual, o procedimento para sua aplicação, com observância aos limites dos poderes para a autocomposição entre as partes, a partir da legislação e conceitos doutrinários do presente instituto.pt_BR
