dc.description.abstractPor intermédio de uma exploração doutrinária e principiológica, pretende-se com o presente estudo apurar se a imposição do regime de separação obrigatória de bens aos maiores de 70 (setenta) anos encontra-se em consonância em relação aos princípios e regras dispostas no ordenamento jurídico pátrio, sobretudo após o advento da Constituição Federal promulgada em 1988. Verificando as consequências jurídicas geradas aos sexagenários, oportunidade em que será apurado se o implemento da restrição legal geraria a limitação do exercício pleno da capacidade civil, analisando, ainda, as consequências sociais produzidas com o implemento da restrição.pt
dc.description.abstractThrough a doctrinal and principled exploration, the present study aims to determine whether the imposition of the mandatory separation of property regime is in line with the principles and rules set forth in the Brazilian legal system, especially after the advent of the Federal Constitution promulgated in 1988. By verifying the legal consequences generated to sexagenarians, an opportunity where it will be determined whether the implementation of the legal restriction would generate the limitation of the full exercise of civil capacity.en
