Resumo
A pesquisa é dedicada ao estudo de como o juiz, no exercício de suas funções, opera a re(construção) narrativa de eventos pretéritos em busca de uma possível verdade, ao final do processo judicial, e tem por base aportes teóricos do Direito e Literatura, mais especificamente do Direito como Literatura, da Teoria da Decisão, da Hermenêutica Filosófica, da Teoria do Direito e da Teoria da História. Por meio da pesquisa bibliográfica, a investigação foi norteada por quatro eixos: (1) evidenciar a aproximação existente entre os ofícios do juiz e do historiador; (2) problematizar as clássicas analogias entre o juiz e o historiador, que - com base na noção de prova - justificou a defesa de que a sentença constitui uma verdade absoluta; (3) abordar as mudanças promovidas pelo narrative turn, na compreensão do Direito e da História, e como essa “cultura da narração” modificou a concepção tradicional de verdade; e, por fim, (4) explicar a necessidade de que as decisões judiciais sejam bem fundamentadas e coerentes, de modo a cumprirem a exigência que figura no artigo 93, inciso IX, da Constituição Federal.
The research is dedicated to the study of how the judge, while fulfilling his duties, operates the narrative re(construction) of past events in search of a possible truth at the end of the judicial process, and is based on theoretical contributions from Law and Literature, more specifically from Law in the form of Literature, Decision Theory, Philosophical Hermeneutics, Law Theory and History Theory. Through bibliographical research, the investigation was guided by four axes: (1) to show the existing link between the professions of the judge and the historian; (2) to problematize the classic analogies between the judge and the historian, that - based on the notion of proof - justified the defense that the sentence constitutes an absolute truth; (3) to address the changes brought about by the narrative turn, in the understanding of law and history, and how that “narrative culture” changed the traditional concept of truth; and finally, (4) to explain the need for judicial decisions to be well-founded and coherent, in such a way that the requirement made in article 93, item IX of the Federal Constitution is fulfilled.
