Resumo
A presente pesquisa parte da concepção de Hesse quanto a força-normativa como elemento capaz de conduzir os fatores reais de poder, e nesse contexto analisa como se dá o fenômeno da mutação constitucional. Trata-se inicialmente da concepção de Ferdinand Lassalle, no texto “A essência da Constituição” e a partir dele aborda a crítica construída por Konrad Hesse através da teoria da força normativa da Constituição. Hesse argumenta que a existência da Constituição é vinculada a realidade e sua eficácia depende do substrato histórico. Na concepção do referido autor a realização da Constituição reside singularmente na vontade constitucional. A busca pela construção de uma teoria constitucional parte da eficácia e aplicabilidade das normas constitucionais. Discute-se o fenômeno da mutação constitucional, a partir de uma relação com força normativa da Constituição e ainda questionando o pano de fundo envolvido na construção teórica do autor alemão. Essa compreensão do fenômeno da mutação constitucional pela via judicial se desenvolve por meio da análise de decisões do Supremo Tribunal Federal, com análise de casos de repercussão geral que trabalham a matéria da mutação constitucional. Através análise jurisprudencial, objetiva-se trabalhar como a Corte Constitucional brasileira vem elaborando o conceito de mutação constitucional. O tema ganha relevância social, política e jurídica e este trabalho pretende colaborar com o debate quanto a concretização das normas constituc ionais, identificando se há coerência no uso do fenômeno e também como os ministros tem deliberado a matéria. Por fim, reflete-se sobre a proeminência da atuação do poder judicial na utilização da mutação constitucional e como seus contornos podem impactar na força normativa da constituição.
This research starts from Hesse's conception of the normative force as an element capable of conducting the real factors of power, and in this context analyzes how the phenomenon of constitutional mutation takes place. It is initially about the conception of Ferdinand Lassalle, in the text “The essence of the Constitution” and from it approaches the critique constructed by Konrad Hesse through the theory of the normative force of the Constitution. Hesse argues that the existence of the Constitution is linked to reality and its effectiveness depends on the historical substrate. In the conception of that author, the realization of the Constitution resides singularly in the constitutional will. The search for the construction of a constitutional theory is based on the effectiveness and applicability of constitutional norms. Hence, the phenomenon of constitutional mutation is discussed, based on a relationship with the normative force of the Constitution and still questioning the background involved in the theoretical construction of the German author. This understanding of the phenomenon of constitutional change through the courts is developed through the analysis of decisions of the Supreme Court, with analysis of cases of general repercussion that work on the matter of constitutional change. Through jurisprudential analysis, the objective is to work on how the Brazilian Constitutional Court has been developing the concept of constitutional change. The theme gains social, political and legal relevance and this work intends to collaborate with the debate regarding the 6 implementation of constitutional norms, identifying if there is coherence in the use of the phenomenon and also how the ministers have deliberated the matter. Finally, it reflects on the prominence of the role of the judiciary in the use of constitutional change and how its contours can impact the normative force of the constitution
