dc.description.abstract	When we are faced with an aeronautical accident many questions come to the fore, these questions can only be answered accurately after the investigation and analysis of the data of such accident and that is what will deal with that work. It was tried to demonstrate how the investigations of an aeronautical accident conducted by the subordinate organ to the Command of the Aeronautics, CENIPA, and the police and judicial bodies are given. The objective was to present the main characteristics of each of them and to show the consequences of them in the air accident investigation process. To this end, the work was based on the following order: a brief introduction to the beginning of aviation and when the need arose for the investigation in the event of an aeronautical accident, how the accident investigation evolved and the main bodies responsible for such an investigation, Introduction of the first legislation on prevention and compensation in the event of an accident, the main conventions adopted for the investigation of the air accident, how the investigation of the accident by CENIPA is conducted, how the police investigation of the accident is conducted , Civil, criminal and criminal liability, as the case is judged by the courts and which major laws and codes are currently being used and finally, analysis of two air accidents in Brazil from the point of view of preventive and criminal investigation. Among the main conclusions obtained, it is possible to mention the importance of the two lines of investigation and how the police investigation is still poorly seen in the aeronautical environment. The study allowed to verify that the guilt factor must be present in an aeronautical accident so that this one is taken to court and with that the responsible ones are incriminated.	en
dc.description.abstract	Ao nos depararmos com um acidente aeronáutico, muitas perguntas vêm à tona, essas perguntas só podem ser respondidas com precisão após a investigação e análise dos dados de tal acidente e é sobre isso que tratará esse trabalho. Buscou-se demonstrar como se dão as investigações de um acidente aeronáutico conduzidas pelo órgão subordinado ao Comando da Aeronáutica, CENIPA, e os órgãos policiais e judiciários. O objetivo foi apresentar as principais características de cada uma delas e mostrar as consequências delas no processo de investigação do acidente aéreo. Para tanto, o trabalho obedeceu ao seguinte ordenamento: uma breve introdução ao início da aviação e em que momento surgiu a necessidade da investigação em caso de um acidente aeronáutico, de que forma a investigação do acidente evoluiu e os principais órgãos responsáveis por tal investigação, introdução às primeiras legislações criadas no que se refere à prevenção e indenização em caso de acidente aéreo, as principais convenções adotadas para a investigação do acidente aéreo, como é conduzida a investigação do acidente pelo CENIPA, como é conduzida a investigação do acidente pela autoridade policial, a responsabilidade civil, penal e criminal, como é julgado o caso pelos tribunais e quais as principais legislações e códigos vem sendo usados atualmente e por fim, análise de dois acidentes aéreos ocorridos no Brasil sob o ponto de vista da investigação preventiva e criminal. Dentre as principais conclusões obtidas, pode-se citar a importância das duas linhas de investigação e como a investigação policial ainda é mal vista no meio aeronáutico. O estudo permitiu constatar que o fator culpa deve estar presente em um acidente aeronáutico para que esse seja levado a juízo e com isso os responsáveis sejam incriminados.	pt_BR
