A importância da capacitação de servidores e magistrados do tribunal regional do trabalho da 12ª região para atuação nos centros judiciários de métodos consensuais de soluções de disputas

Resumo
Com este estudo pretende-se demonstrar a relevância da capacitação de servidores e
magistrados, em cursos de conciliação, para atuação nos Centros Judiciários de Métodos
Consensuais de Soluções de Disputas (CEJUSCs), no âmbito do Tribunal Regional do
Trabalho da 12ª Região de Santa Catarina. Para tanto, analisa-se a Política Pública
Judiciária instituída pela Resolução n. 125/2010 do Conselho Nacional de Justiça (CNJ)
e a obrigatoriedade da capacitação de servidores e magistrados após a edição da
Resolução n. 174/2016 e da Resolução CSJT n. 288/2021, ambas do Conselho Superior
da Justiça do Trabalho (CSJT), e a recepção destas pela Portaria Conjunta
Seap/Gvp/Secor n. 139/2022, que dispõe sobre o Núcleo Permanente de Métodos
Consensuais de Solução de Disputas e sobre os Centros Judiciários de Métodos
Consensuais de Solução de Disputas no âmbito do Tribunal Regional do Trabalho da 12ª
Região. O estudo fundamenta-se metodologicamente em levantamento bibliográfico e
análise contextualizada de diálogo com sujeitos que atuam no processo de conciliação.
Os resultados da pesquisa demonstram que após a instituição dos Núcleos Permanentes
de Métodos Consensuais de Solução de Disputas do Tribunal Regional do Trabalho
(NUPEMECs-JT) e dos Centro(s) Judiciário(s) de Métodos Consensuais de Solução de
Disputas (CEJUSCs-JT), a atuação de servidores e magistrados nesses centros deve ser,
obrigatoriamente, precedida por capacitação, ofertada pelo próprios TRTs ou pela Escola
Nacional de Formação e Aperfeiçoamento de Magistrados do Trabalho (ENAMAT).
Demonstram ainda que o Tribunal Regional do Trabalho da 12ª Região vem ofertando a
capacitação de forma sistemática mediante o Programa de Formação de Conciliadores.
This study aims to demonstrate the relevance of training public employees and labor magistrates, in conciliation courses, to work in the Judicial Centers for Consensual Methods of Dispute Resolution (CEJUSCs), within the ambit of the Regional Labor Court of the 12th Santa Catarina region. To this end, the Judicial Public Policy established by Resolution n. 125/2010 of the National Council of Justice (CNJ) and the mandatory training of public employees and labor magistrates after the publication of Resolution n. 174/2016 and Resolution n. 288/2021, both from the Superior Council of Labor Justice (CSJT), and their reception by Ordinance Seap/Gvp/Secor n. 139/2022, on the Permanent Center for Consensual Dispute Resolution Methods and on the Judicial Centers for Consensual Dispute Resolution Methods within the ambit of the Regional Labor Court of the 12th Region. The study is methodologically based on bibliographical research and contextualized analysis of dialogue with subjects who work in the conciliation process. The research results demonstrate that after the establishment of the Permanent Centers for Consensual Methods of Dispute Resolution of the Regional Labor Court (NUPEMECs-JT) and the Judicial Center(s) for Consensual Methods of Dispute Resolution (CEJUSCs-JT), the work of public employees and labor magistrates in these centers must necessarily be preceded by training, offered by the TRTs themselves or by the National School for Training and Improvement of Labor Magistrates (ENAMAT). They also demonstrate that the Regional Labor Court of the 12th Region has been offering training systematically through the Conciliator Training Program.
