Resumo
O instituto da guarda compartilhada é um importante instrumento jurídico criado com o objetivo de trazer igualdade na divisão de responsabilidades por pais, ou responsáveis, na criação de seus filhos. Neste sentido, as regras vigentes a esse instituto estão sendo aplicadas também na manutenção dos cuidados aos animais de estimação por seus tutores. Com isso, o objetivo geral do presente estudo científico é em apresentar as possibilidades jurídicas da utilização da guarda compartilhada aos animais de estimação, destacando o posicionamento do Poder Judiciário no tocante a essa possibilidade, como também, as principais características empregadas nesses casos. Contudo, esse tema gera algumas inquietações, tais como, as delimitações legais para aplicação do instituto da guarda compartilhada previsto na esfera do Direito de Família aos pets. Assim, surgem algumas questões que deram origem ao problema de pesquisa, como por exemplo, como é realizada a guarda compartilhada dos pets? Quais os direitos e deveres dos tutores? A partir dos questionamentos mencionados cabe debater a função da guarda compartilhada na manutenção do bem-estar dos pets, principalmente a respeito da divisão de tarefas pelos tutores. A metodologia empregada para o desenvolvimento do presente trabalho será utilizada uma abordagem qualitativa, aplicada, por meio do método dedutivo, da pesquisa bibliográfica e exploratória em artigos, livros, em legislações, sites jurídicos, normas específicas referentes ao Direito de Família e o instituto da guarda compartilhada. The joint custody institute is an important legal instrument created with the aim of bringing equality in the division of responsibilities by parents, or guardians, in raising their children. In this sense, the rules in force at this institute are also being applied in the maintenance of pet care by their guardians. Thus, the general objective of this scientific study is to present the legal possibilities of using shared custody for pets, highlighting the position of the Judiciary regarding this possibility, as well as the main characteristics used in these cases However, this theme generates some concerns, such as the legal delimitations for the application of the shared custody institute provided for in the sphere of Family Law to pets. Thus, some questions arise that gave rise to the research problem, such as how is the shared custody of pets performed? What are the guardians' rights and duties? From the aforementioned questions, it is worth discussing the role of shared custody in maintaining the well-being of pets, especially regarding the division of tasks by guardians. The methodology used for the development of the present work will be used a qualitative approach, applied, through the deductive method, of the bibliographical and exploratory research in articles, books, in legislations, legal sites, specific norms referring to the Family Law and the institute of the shared custody.
