Resumo
Este estudo tem por objeto analisar a jurisprudência do Superior Tribunal de Justiça quanto ao momento de oitiva do adolescente em conflito com a lei, se deve ser ouvido já no primeiro ato da instrução como disciplina o Estatuto da
Criança e do Adolescente ou lado outro como derradeiro ato como disciplina do Código de Processo Penal. Para lograr êxito no desiderato foi utilizado o método de abordagem dedutivo, uma vez que se partiu de noções gerais acerca do procedimento de apuração de ato infracional para, somente após, analisar as nuances envolvidas em cada procedimento. O tipo de abordagem foi o qualitativo. Por procedimento de coleta de dados, utilizou-se o bibliográfico,
porque a base eram obras pré-constituídas. A pesquisa, em seu nível é exploratória; para instrumentalizar os dados pesquisados, utilizou-se o fichamento bibliográfico. Após o estudo, em conclusão, vê-se que a aplicação do
rito previsto no Código de Processo Penal, com a oitiva do adolescente ao término da instrução é a maneira que melhor reflete o devido processo legal e os princípios dali inerentes, bem como os princípios constitucionais afeitos à
infância e juventude.
This study aims to analyze the jurisprudence of the Superior Justice Court regarding the moment in which adolescents in conflict with the law should be heard, whether they should be heard in the first act of the instruction with discipline, the Child and Adolescent Statute or another side such as final act as a discipline of the Code of Criminal Procedure. To achieve success in this aim, the deductive approach method was used, since it started from general notions about the procedure for investigating an infraction and, only after, analyzing the nuances involved in each procedure. The type of approach was qualitative. For the data collection procedure, bibliography was used, because the basis was preconstituted works. Research, at its level, is exploratory; to instrument the researched data, bibliographic records were used. After the study, in conclusion, it is seen that application of the rite provided for in the Code of Criminal Procedure, with the hearing of the teenager at the end of the instruction, is the way that best reflects due legal process and the principles inherent therein, as well as the principles constitutional provisions related to childhood and Youth.
