Resumo
Este artigo científico discute se a guarda compartilhada é a solução para inibir a
alienação parental, tão presente nos dias atuais. Além disso, tem como objetivo
analisar, discutir e apresentar os principais aspectos teóricos. Dessa forma, através
deste artigo, será apresentado que ambos os pais têm o direito de viver uma vida
equilibrada com os seus filhos, bem como cuidar, proteger e criá-los. Com isso,
também, será esclarecido que mesmo após o término da relação conjugal, ambos os
genitores têm os mesmos direitos e obrigações para com os filhos. Por fim, estuda-se
as modalidades de guardas, bem como suas relações com a alienação parental, além
da análise a respeito da consequente utilização da guarda compartilhada como forma
preventiva ou mesmo solução nos casos de alienação parental.
This scientific article discusses whether shared custody is the solution to inhibit parental alienation, so present today. Furthermore, it aims to analyze, discuss and present the main theoretical aspects. Therefore, through this article, it will be shown that both parents have the right to live a balanced life with their children, as well as to care for, protect and raise them. With this, it will also be clarified that even after the end of the marital relationship, both parents have the same rights and obligations towards their children. Finally, the types of custody are studied, as well as their relationship with parental alienation, in addition to the analysis regarding the consequent use of shared custody as a preventive measure or even a solution in cases of parental alienation.
