Monografia Acesso aberto Lei da Mata Atlântica: uma reflexão acerca da proteção da vegetação nativa nas áreas urbanas e regiões metropolitanas(2015) Sell, Eliza Branco DuarteThe Atlantic Forest biome is one of the richest regions in biodiversity in the world, and according to VARJABEDIAN (2010) The Atlantic Forest is considered one of the greatest repositories of biodiversity on the planet. However, it is a biome extremely threatened by human occupation, in which since its colonization it has been using its resources and occupying its space. The SOS Atlantic Forest Foundation claims that today, there are only 8.5% of remaining forest above 100 hectares from what has originally existed in this forest, and this reduction affects us directly as water and natural resources consumers that we are. Thus, the Atlantic Forest uncontrolled exploitation brings forth a big concern about the survival future of this biome. On December 22, 2006, the Law nº 11.428/06 (Atlantic Forest Law) was enacted and signed, which is less restrictive in protecting the Atlantic Forest in comparison to the Federal Decree Nº 750/93, nevertheless, it was a way to regulate the use of the forest in line with the growth of cities and with the sustainable development. This paper brings up a specific issue on Chapter VI of the law mentioned above, which deals with the protection of the Atlantic Forest in urban areas and metropolitan regions, and how much more restrictive this chapter could be to favor the increasing of forest areas in urban environments. It argues the practical enforcement of the Atlantic Forest Law on environmental licensing processes, and it technically proves a small and more restrictive changings in some sections, along with better urban counties systems which could result in better improved environmental quality of municipal urban perimeters.
